Ultimate Indoor Garage Sale Operated by Heritage Event Company

By accessing or using the Ultimate Indoor Garage Sale website (the “Site”) or purchasing any vendor spaces, tables, add-ons, or admission tickets, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site or make any purchases.
1. Eligibility
You must be at least 18 years of age to make a purchase or register as a vendor. By using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
2. Vendor Spaces, Tables, Add-ons & Admission Tickets
All purchases of vendor spaces (including booths of any size), tables, electrical access, and any other add-ons, as well as admission tickets, are final. All orders are non-transferable and non-refundable. No refunds, credits, or exchanges will be issued for any reason, including cancellation by the purchaser, change of plans, or inability to attend.
Vendor spaces are assigned at the sole discretion of Heritage Event Company. We reserve the right to change booth locations, reconfigure the floor plan, or make other adjustments as needed for the successful operation of the event.
3. Payment Plans (Vendors Only)
If a payment plan is selected for a vendor space, you must complete all scheduled installments by the stated due dates. Failure to do so will result in the immediate forfeiture of all amounts previously paid. The space will be released for resale, and you may be banned from participating in future Ultimate Indoor Garage Sale events or other events produced by Heritage Event Company.
4. Force Majeure
If any Ultimate Indoor Garage Sale event is cancelled or postponed due to circumstances beyond our reasonable control — including but not limited to acts of God, natural disasters, severe weather, fire, flood, pandemic, government restrictions or orders, venue unavailability, civil unrest, or other force majeure events — Heritage Event Company reserves the right to cancel or reschedule the event. In such cases, purchasers will receive either a full refund or a credit, at our sole discretion, toward a future event of equal or greater value. No additional compensation (including travel, lodging, or lost revenue) will be provided.
5. Event Rules & Conduct
Vendors and attendees must comply with all rules, regulations, and instructions issued by Heritage Event Company and the venue. We reserve the right to refuse entry, remove any person, or revoke a vendor space without refund for any conduct we deem inappropriate, disruptive, unsafe, or in violation of these Terms or event rules.
6. Intellectual Property
All content on the Site — including text, graphics, logos, images, and software — is the property of Heritage Event Company or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or use any content from the Site without our prior written permission.
7. Limitation of Liability
To the fullest extent permitted by law, Heritage Event Company and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any purchase, or your participation in any event. Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Heritage Event Company and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your purchases, your participation in any event, or your violation of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Arapahoe County or Larimer County, Colorado.
10. Changes to These Terms
We may update these Terms of Service from time to time. The “Last Updated” date at the top of this page will indicate when changes were made. Your continued use of the Site or participation in events after any changes constitutes acceptance of the revised Terms.
11. Photography & Media Release
By attending or participating in any Ultimate Indoor Garage Sale event, you acknowledge and agree that Heritage Event Company, its staff, contractors, and authorized media may photograph, video, or otherwise record the event, including vendor booths, merchandise, and the likeness of any person present. You grant Heritage Event Company a perpetual, royalty-free, worldwide license to use, reproduce, display, and distribute such images and recordings (including those featuring your merchandise or likeness) for any promotional, marketing, advertising, archival, or commercial purpose without further notice, consent, or compensation. You waive any right to inspect or approve the finished product and release Heritage Event Company from any claims arising from such use.

RETURN POLICY

All sales are final. All orders — including vendor spaces (booths, tables, electrical, and any add-ons) and admission tickets — are non-transferable and non-refundable. No refunds, credits, or exchanges will be issued for any reason, including cancellation by the purchaser.
If a vendor payment plan is selected, failure to complete all installments by the stated due dates will result in the immediate forfeiture of every payment made to date. The space will be released for resale, and the vendor may be banned from future Ultimate Indoor Garage Sale events and other Heritage Event Company events.
